What grounds are recognised for divorce in Singapore?
Singapore law recognises one ground for divorce — that the marriage has irretrievably broken down. This is demonstrated through one of several facts, including separation of at least three years with consent, separation of four years without consent, adultery, unreasonable behaviour, or desertion. We can help you assess which applies to your situation during an initial consultation.
How long does a divorce typically take in Singapore?
A simplified (uncontested) divorce can be completed in as few as four to six months where both parties are in agreement on all matters. Contested proceedings, particularly those involving disputes over children or assets, may extend to one to two years depending on the complexity of the issues. We work to help parties reach agreement wherever possible to shorten the process.
How does the court approach child custody decisions?
Singapore family courts are guided primarily by the welfare of the child. Factors considered include the child's emotional ties to each parent, each parent's capacity to provide care, established routines, and — depending on age — the child's own views. Joint custody is commonly ordered, with care and control assigned to one parent and access granted to the other, though arrangements vary considerably across families.
What assets are considered matrimonial assets?
Matrimonial assets generally include all property acquired during the marriage and any pre-marital assets substantially improved or ordinarily used by the family. This includes the matrimonial home, CPF savings, investment accounts, vehicles, and business interests. Assets received as gifts or inheritance are usually excluded unless they have been substantially intermingled with family assets.
